Online Store Terms and Conditions    

§1. General Provisions.    

The owner of the Online Store is INDELIBLE BOOKS Publishing, located at 6B Oborska Street,  05‐510Konstancin‐Jeziorna, Poland, REGION 011111202, VAT ID 526‐101‐3470.  The INDELIBLE BOOKS Publishing Online Store sells eBooks and MP3 files presented on the  INDELIBLE-BOOKS.com.pl website.  INDELIBLE BOOKS is registered by CEIDG, by Minister of Development and Technology  The store accepts orders from around the world. 

§2. Orders

     The INDELIBLE BOOKS Online Store accepts orders placed:  via the electronic order form on the INDELIBLE-BOOKS.com.pl website. Electronic orders placed via this form on the INDELIBLE-BOOKS.com.pl website are accepted  24 hours a day.  Creating an account is not required to place an electronic order. However, any customer  with an active email address can create an account. An account is automatically created for a  customer making his/her first order when s/he express the desire to purchase items in  his/her cart.  To process an order, it is necessary to provide correct information (fields marked with an  asterisk). Providing a valid email address by the customer is a condition for sending an email  confirmation of the contract to that address.  The customer should receive an order confirmation immediately after placing the order.  The bookstore reserves the right to verify the order for its accuracy and may cancel the  order if it is found to be unreliable.

  §3. Terms of Sale

     All prices are listed in US dollars and include VAT. The price listed for a product at the time  the customer places the order is binding.  The bookstore reserves the right to change the prices of products in its offer, introduce new  products, conduct and cancel promotional campaigns on the bookstore’s website.  By accepting the provisions of these terms and conditions, the customer agrees to receive a  VAT invoice for each order placed, which will be issued after the goods are assembled. The  customer can settle the payment by electronic transfer (e‐transfer) or by credit card through  the imoje systemservedby ING Bank Slaski SA, Katowice, Poland.,as well as by bank transfer  to the following account: SWIFT: INGBPLPW  IBAN: PL 82 1050 1025 1000 0097 9292 1703  Orders paid by electronic transfer or credit card will be processed within 24 hours.

  §4. Rules for the Sale of Digital Files

  I. Placing an Order  Customers can order only one copy of a specific eBook or MP3 file.  In the case of purchasing an eBook or MP3 file, the product will be made available to the  customer’s account on the INDELIBLE BOOKS Online Store website, and in the case of  electronic payment, on the order confirmation page.  On the product page of each eBook or MP3 file, the INDELIBLE BOOKS Online Store will  provide information about the format in which the digital file is saved. Each eBook or MP3  file purchased from the INDELIBLE BOOKS Online Store can be used on any device that  supports the format in which the digital file was downloaded.  If a customer orders both eBooks/MP3s and other types of products simultaneously, the  order can only be paid for via electronic payment.    

II. Order Fulfillment Conditions  An order containing eBooks or MP3 files will be processed upon receiving confirmation of a  successful payment from the entity handling electronic payments.  After receiving information about a completed payment, the UNFORGETTABLE Online Store  will send an email to the customer’s provided email address, which will include:     Confirmation of payment receipt.  Information on how to download the eBook or MP3 file.  If fulfilling the order is not possible, the UNFORGETTABLE Online Store will inform the  customer of the situation by sending an email to the address provided by the customer. In  the event of the customer making an advance payment for such an order, the  UNFORGETTABLE Online Store will refund the amount paid. 

III. Right of Withdrawal  A customer has the right to withdraw from an order until the digital file is downloaded from  the INDELIBLE BOOKS Online Store. The store will refund the amount paid by the customer.  The right to withdraw from the contract does not apply to digital content that is not stored  on a tangible medium, if the performance of the service has begun with the customer’s  express consent and after informing the customer about the loss of the right to withdraw  from the contract (in accordance with Article 38 of the Act of May 30, 2014, on customer  rights ‐ consolidated text of June 24, 2014, Journal of Laws of 2014, item 827). 

IV. Use of eBooks and MP3 Files  Purchased and paid eBooks and MP3 files will be accessible to the customer after logging  into the INDELIBLE BOOKS Online Store in the “My Account” section, under “My  Downloadable Files.” For customers who make electronic purchases without logging in, the  files will be available on the order confirmation page.  To download an eBook or MP3 file, click the “Download” button next to the product. After  clicking, the file will be available for download.  In the case of eBooks or MP3 files consisting of more than one file, a list of files will be  included in a .zip file.  Customers are advised to save eBooks and MP3 files on their own storage devices after  making a purchase. The store does not provide storage services for purchased digital files in  the INDELIBLE BOOKS Online Store, so the customer bears the risk of not saving these files  on a separate storage device.  All eBooks and MP3 files offered by the INDELIBLE BOOKS Online Store are subject to the  protection provided for in the Act of February 4, 1994, on copyright and related rights, and  may be used only in accordance with the provisions of these terms and conditions and the  license.  Customers have the right to use eBooks and MP3 files for their personal use only, in  accordance with applicable law.  Customers are not authorized to:     Distribute eBooks and MP3 files or their derivatives in whole or in part.  Record or reproduce eBooks and MP3 files for the purpose of distribution.  Commercially use eBooks and MP3 files in any way.  Customers are responsible for ensuring that unauthorized persons do not use eBooks and  MP3 files in a manner that violates the law, the terms and conditions, and the provisions of  the license. 

V. Complaints  Customers can report complaints to the INDELIBLE BOOKS Online Store, especially if:  The purchased eBook or MP3 file turns out to be damaged.  Within 24 hours of making a confirmed electronic payment for an eBook or MP3 file, the  customer is not provided with the opportunity to download it.  The store will respond to complaints within 14 (fourteen) calendar days.  §7. Complaints     Customers have the right to file a complaint if the product is found to be of low quality or  not in accordance with the ordered product.  The store will promptly consider complaints. If a complaint is accepted, the product will be  replaced with an equivalent product, and if this is not possible, the customer will receive a  refund of the costs incurred. 

§8. Final Provisions

     The INDELIBLE BOOKS Online Store, as the seller, is responsible to the customer for physical  and legal defects of the purchased product in accordance with Article 556 and subsequent  provisions of the Civil Code (consolidated text of the Journal of Laws of 2014, No. 121).  By placing an order, the customer declares that s/he accepts the above Terms and  Conditions and consents to the processing of s/he personal data for the purpose of order  fulfillment. This data is not shared with other entities. The personal data provided by the  customer is processed and secured in accordance with the Act of August 29, 1997, on  personal data protection (Journal of Laws No. 133, item 883, as amended).  These Terms and Conditions are effective from October 1, 2023.
